Medical malpractice involves harm to a patient before death, while wrongful death specifically deals with situations where that malpractice leads to a patient's death. Most times, wrongful death cases involve an aspect of conscious pain prior to death and suffering for the family following the death. In a wrongful death case, the family (through the estate) files a claim, asserting that negligent care caused the patient’s death.
While any portion of a claim involving pain and suffering before death are subject to financial caps on non-economic damages, in Ohio, wrongful death cases resulting from medical malpractice are not subject to caps on damages. This means there is no limit on the amount a family can recover for non-economic damages, such as pain and suffering, loss of companionship, or mental anguish. Damages are determined based on the losses experienced by the family, including financial support and emotional suffering.
Ohio has a two-year statute with some limited exceptions for wrongful death. The portion of the claim for pain and suffering before death may be as short as one year from the date of the malpractice. It’s important to consult a lawyer quickly to ensure you meet deadlines.
